These Terms of Service ("Terms") govern your use of the website and Australian data services provided by Capstone Data ("Capstone Data," "we," "us," or "our"), a trading name of Capstone Anchor, LLC, at capstoneanchor.com/au/. By accessing our website, submitting a form, booking a call, or purchasing a dataset, you agree to these Terms.
These Terms apply to our Australian product. Our United States terms, which govern the United States product, are at capstoneanchor.com/terms-of-service.html. If you buy in both markets, each set of terms governs the product supplied in its market, and both apply to you accordingly.
Capstone Data operates a satellite-verified solar property intelligence platform serving Australia. We identify Australian properties with rooftop solar, verify that the address is real and mail-deliverable, and attach hail and storm intelligence and area-level household income.
Every record we deliver has solar confirmed on the roof, an address that has been verified and formatted for delivery by Australia Post, and a hail and storm assessment on file. Our data guarantee applies at the moment of delivery.
The Australian dataset is a direct-mail property product. It contains property addresses and property attributes. It does not contain householder names, phone numbers, or email addresses, and we do not trace or profile Australian householders. We do not offer those fields at any price, because unsolicited electronic and telephone marketing to householders is restricted in Australia by the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth), and Australian Privacy Principle 7.
If you wish to append registered owner names, you must obtain them yourself, under your own licence and in accordance with the terms of whoever supplies them to you. We do not supply, broker, or resell owner names, and nothing in these Terms should be read as permission to represent that we do.
This clause is the core of our commercial relationship. On payment, we grant you a non-exclusive, non-transferable licence to use the delivered dataset on the terms set out below.
The licence in four lines. Everything below expands on these.
The dataset consists of property addresses and property attributes only: the address, whether solar is present on the roof, hail and storm intelligence for that property, area-level household income, and, where a state publishes it, a statutory land value. It contains no name, no telephone number, no email address, and no other contact point for any individual. It is a description of buildings and land, not of people.
The dataset is licensed for one channel: addressed physical mail sent to the property. You may use it to select properties, to plan and prioritise a mail campaign, and to address and send mail pieces. You must not use it, alone or combined with anything else, to make telephone calls, send SMS, send email, serve targeted digital advertising to an individual, or make any decision about a person's credit, insurance, tenancy or employment.
You are solely responsible for ensuring that your use of any dataset we deliver complies with all applicable Australian law, including without limitation the Privacy Act 1988 (Cth) and the Australian Privacy Principles, the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth), the Australian Consumer Law, and any state or territory law that applies to your business or your campaign. You are responsible for your own mail piece, your own claims, your own suppression and opt-out handling, and your own record-keeping. We do not review, approve or supervise your campaign, and we are not your compliance adviser.
You must not represent a hail or storm figure supplied by us as a measured hail size, a surveyed damage assessment, an insurance determination, or a substitute for a physical inspection. See clause 6.
We are a data supplier, not a marketing agency. Our obligations are discharged when the dataset is delivered and the guarantee in clause 7 has been honoured. We do not send mail on your behalf, do not manage or monitor your campaign, and have no role in, visibility of, or control over what you do with the data after delivery.
The dataset is warranted as at the moment of delivery and only to the standard in clause 7. Beyond that, and subject to any rights under the Australian Consumer Law that cannot be excluded, the dataset is supplied "as is". We give no warranty that it will remain accurate over time, that any property will respond, that any campaign will produce a particular result, or that the data is fit for any purpose other than the permitted channel in clause 3.2.
You indemnify Capstone Data, and its officers and employees, against all claims, demands, proceedings, losses, damages, fines, penalties, costs and expenses (including reasonable legal costs) arising out of or in connection with: (a) your use of the dataset after delivery; (b) any breach by you of clauses 3.2 or 3.3; (c) the content, claims or conduct of any campaign you run using the dataset; and (d) any representation you make about the dataset, its accuracy or its provenance that we did not make in writing. This indemnity survives termination of these Terms.
Unless your order says otherwise, the licence is for your own business use. Where your order is a supplier or bulk order that expressly grants on-supply rights, you may supply the dataset onward only if you pass on the licence terms delivered with it, and only to a recipient who agrees to them. You remain responsible for your recipient's compliance.
You agree to use capstoneanchor.com only for lawful purposes. You may not:
Prices shown on the Australian site are in Australian dollars (AUD). Prices are subject to change, and the price applicable to your order is the price confirmed to you at the time of order. Any taxes or duties applicable to your purchase are your responsibility unless we state otherwise in writing.
Proof-of-concept credit. Where you purchase a proof-of-concept pack, the amount you paid for it is credited in full against a qualifying order placed within 10 days of the date the pack was delivered to you. A qualifying order is an order of 1,000 records or more. The credit applies once, is not redeemable for cash, is not transferable, cannot be combined with another credit for the same order, and expires at the end of the tenth day after delivery.
Hail figures we supply are modelled estimates derived from weather radar. You acknowledge and agree that:
Land value figures, where supplied, are statutory land values published by a state authority. They are not market valuations of the property or the dwelling and must not be represented as such. Household income figures are area-level statistics and do not describe any individual household.
When you purchase a dataset from Capstone Data, we guarantee that at the moment of delivery every record has solar confirmed on the roof, an address that has been verified and is deliverable, and a hail and storm assessment on file, subject to what is published for that market.
If any record in your delivered dataset fails those criteria at the moment of delivery, it will be replaced under our unlimited replacement guarantee. This guarantee applies to the state of the data at delivery and does not account for change over time, including solar systems removed or installed, buildings demolished or rebuilt, or subsequent weather events.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
All content on capstoneanchor.com, including text, design, graphics, logos, and code, is the property of Capstone Data and is protected by applicable intellectual property laws. Our detection, verification and modelling systems, and the derived outputs they produce, are our intellectual property. The licence in clause 3 grants you a right to use a delivered dataset; it transfers no ownership. You may not reproduce, distribute, or create derivative works from our content without written permission.
Subject to clause 7 and to any rights you have under the Australian Consumer Law that cannot be excluded, our website and services are provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted or error-free, and we do not guarantee specific commercial results from using our data.
To the fullest extent permitted by law, and subject to any rights under the Australian Consumer Law that cannot be excluded, Capstone Data shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website, our services or a delivered dataset, including lost profits, data loss, wasted campaign spend, or service interruption. Where liability cannot be excluded, our liability is limited, at our option, to resupplying the dataset or refunding the amount you paid for it.
Our services rely on third-party platforms including our booking calendar system and hosting. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the practices of third-party providers.
Your use of our website and services is also governed by our Australian Privacy Policy, which is incorporated into these Terms by reference.
We reserve the right to update these Terms at any time. Changes will be posted to this page with an updated "Last Updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms. The Terms that govern a dataset are those in force on the date of your order.
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law provisions, and you submit to the non-exclusive jurisdiction of the courts of New Jersey. Nothing in this clause limits any right you have to bring proceedings, or any protection available to you, under the Australian Consumer Law or other Australian law that cannot be excluded by agreement. Your obligations under clause 3.3 to comply with Australian law are unaffected by the choice of governing law.
